中国人权律师团律师关于王玉文、王利芹夫妇煽动颠覆国家政权案的呼吁

王玉文（网名：王藏）、王利芹夫妇涉嫌煽动颠覆国家政权一案，经楚雄州公安局侦查终结，已经移送楚雄州检察院审查起诉。我们从多方获得的信息表明，楚雄州公安局以及当地派出所在办理王藏夫妇涉嫌煽动颠覆国家政权案中存在非常严重的违法行为，这些违法行为既超越了法律的底线，也违背了天理人情。

楚雄公安在本案中存在以下问题：  

一、随意扩大调查、侦查对象，不仅抓捕了王藏的妻子王利芹，而且还调查了王藏的表亲、姻亲以及近亲属，更令人瞠目结舌的是，王藏的亲弟弟仅仅因为探访王藏家的四个孩子，竟然被楚雄公安以包庇罪取保候审。 

二、非法限制王藏家人的人身自由，王藏被拘留后，当地派出所24小时监控王藏家人，跟踪王藏母亲和四个小孩，给王藏家人造成极为恐惧的心理氛围。楚雄公安在王藏住所小区内设置24小时监控点，该类监控毫无法律依据，不仅影响小区居民生活，而且还随意盘查探访人员，侵犯公民人身及人格权利，甚至连辩护律师也不得不接受非法登记才能探访王藏的母亲和四个幼儿。 

三、随意截留、阻止各地热心朋友邮寄给王藏家人的各种物品，导致王藏家人货品奇缺，无法满足日常需要。

四、随意没收王藏亲友的私人物品。据了解，当地公安已经没收了王藏家人的多部手机，包括王利芹妹妹和王藏母亲的手机，目前只准许给王藏母亲一部老人机，禁止老人使用智能手机，致使老人无法使用便捷的聊天工具等。  

五、任意株连家属，王利芹仅仅因为在网上替自己的丈夫呼吁，就遭到警方抓捕，楚雄警方置四个幼儿于不顾，将王藏夫妇一体捕拿，实在令人震惊万分！ 

王藏父亲于2019罹患癌症去世，家属尚处悲痛之中，而今天，王藏夫妇因言获罪，身陷囹圄，四个幼儿中，大的12岁，小的两个双胞胎只有4岁，啼饥号寒，嗷嗷待哺，其遭受的心理伤害，不可估量。王母年事已高，健康堪忧，根本无法抚养诸多孙辈，所谓“一抔黄土未干，六尺之孤何托”，试看今日之楚雄，究竟还有无天理人伦？

我们同时发现，近年来各地公安在办理此类案件中，对家属多有骚扰、传唤，甚至采取刑事强制措施，从余文生案对许艳采取监视居住到覃永沛案对其两个女儿的询问，从程渊案对施明磊的传唤和财产扣押到今天对王藏妻子王利芹的逮捕。

我们发现，中国人权状况在持续恶化，公安的肆意违法越来越疯狂，且越来越冷血，而楚雄公安无疑再次刷新了人性的底线。

我们呼吁，楚雄公安应立即亡羊补牢，释放王藏夫妇，让他们的四个幼儿能享受到最起码的亲情，这是做人的道德底线。我们将持续关注王藏、王利芹夫妇，以确保他们获得自由。
