【港版國安法】人大稱按「新形勢」立法 外交部恐激嬲全球急向各國發「開脫文」

（更新：內容） 早前傳媒報道，今晚主管港澳政策的官員將召見香港政協代表，極可能宣佈今年全國人大的議程中，會將內地的國家安全法直接納入香港《基本法》附件三當中，成為在香港實施的全國性法律，直接繞過香港立法會，跳過《基本法》23條的立法程通，可能直接兌現「一國一制」。人大發言人張業遂指，全國人民大會作為最高國家權力機關，根據新形勢和需要，行使憲法賦予的職權，從國家層面建立健全香港特區，維護國家安全的法律制度和執行機制，堅持完善一國兩制制度體系完全必要。全國人大的其中一項議程，是包括「建立健全香港特別行政區維護國家安全的法律制度和執行機構的決定」，並將會在本月28日表決。

多國媒體均有大肆報道港版《基本法》事件，中國外交部疑憂立法嚴重影響中國形象，《香港01》收到外交部向各國駐京大使代表發出的信件，解釋港版《國安法》的立法原因：

  1. 香港反對派長期與外部勢力合謀，去年6月起的反送中事件，破壞香港法治和穩定，打擊香港經濟和民生，嚴峻挑戰「一國兩制」，已成為中國國家安全的顯著風險來源；
  2. 中央政府不能袖手旁觀，經由全國人大審議香港維護國家安全法案；
  3. 港獨分子只佔極少數，為了保護大多數守法的港人，修法是符合香港社會的根本利益
  4. 外交部強調香港是中國的特別行政區，香港國安全立法為中國內部事務，任何國家不得干涉；
  5. 外國與香港保持緊密經濟合作與人員往來，香港的繁榮和長期穩定符合國際社會共同利益，希望外國大使理解和支持中國的做法。
    據內媒報道，有關議案會在明天開幕的全國人大會議上提出，並會安排說明會，人大會安排相關官員出席解說。正在北京的工聯會會長吳秋北表示，全國人大共有9項議程，香港《國安法》議程「全國人民代表大會關於建立健全香港特別行政區維護國家安全的法律制度和執行機制的決定（草案）」，則排在第5項表決。

    表決通過後交由常委會決定細節。按慣例，下次人大常委會會議將於下月召開，預計最快在8月通過並在香港執行。
    不少本港傳媒報道，北京當局急於將內地的《國安法》推到香港實施，目的是要「堵塞香港國安漏洞」，同時會列明具體罰則，而且有關過程，只需要全國人大提案、通過後即能實施。
    亦有傳媒報道，正在北京的全國政協委員接到通知，晚上到政協禮堂出席簡報會，預計政協副主席夏寶龍將會向政協委員講述對於國安法的法律制度問題。這是罕有地政協在晚上舉行簡報會。
    北京的外交圈消息指出，在全國人大舉行記者會後，中央在今晚10時與在外交官見面，講述香港目前的情況。而外交界的消息早前曾經指出，包括美國、英國、歐盟、加拿大、日本、澳洲等西方國家的駐港領館人員，並沒有準確收到會在中國兩會「強推」《基本法》23條、國安條例立法的消息。
    目前《基本法》附件三，當中包括12條涉及軍事、外交的內地法例，《基本法》23則規定，香港應自行立法，禁止所有「叛國、分裂國家、煽動叛亂、顛覆中央人民政府及竊取國家機密」行為，同時亦要禁止外國的政治性組織或團體在香港進行政治活動，禁止香港政治性組織或團體與外國的政治性組織或團體建立聯繫。
    《基本法》第18條則列明，全國性法律除列於本法附件三外，不得在香港實施，而凡在附件三內的法律，由香港當地公佈或立法實施。
    內地的《國家安全法》在2015年7月1日頒佈實施，當時聲稱是因應「國家安全面臨的新形勢新任務」而立法，條文包括各種新的國家安全觀念，如政治安全、國土安全、軍事安全、經濟安全、文化安全、社會安全、科技安全、信息安全、生態安全、資源安全、核安全等等。
    當時港府曾經發表聲明，「有關法律不在香港特別行政區實施」，政府亦未有計劃就《基本法》23條立法，時任香港行政長官梁振英、律政司司長袁國強亦重申這觀點。
