张展面临5年刑期威胁 武汉家属驳当局指控

中共肺炎爆发后 因为武汉当局隐瞒疫情 张展只身一人赶往武汉报导当地灾情真相

亲身到武汉跟踪报导中共病毒（武汉肺炎）肆虐期间当地民生状况的公民记者张展，在被羁押半年后传出消息，中共检方拟以“寻衅滋事罪”予以起诉并建议量刑5年，引发外界关注。

甘肃维权律师李大伟对大纪元记者表示，他周一（11月9日）与张展母亲通话，她母亲没有透露张展在里面的详细情况，仅表示张展还在绝食。但可以想像得到，已经绝食几个月了，身体状况会是怎么样子。

早前有消息说，上海浦东新区检察院作为张展的公诉人，将要求法官对张展“寻衅滋事”案的建议刑期为5年。据中共《刑法》第二百九十三条，有关寻衅滋事量刑为五年以上、十年以下有期徒刑，并处罚金。

对此，李大伟认为，“建议要判五年”，一般检察院是不会把这个刑期说出来的，这样写在起诉书上，这明显是一种恫吓，给张展施加压力的。

今年中共肺炎疫情在武汉首先爆发后，当局长期隐瞒导致疫情蔓延全球。上海女律师张展赶在封城前只身一人前往武汉，实地报导武汉疫情，揭露武汉当局众多掩藏的真相，打脸中共当局，于5月14日在武汉火车站附近被捕，一直被羁押在上海市浦东新区看守所。

六个月以来，张展在看守所中以绝食表达抗议至今，身体状况令人担忧。

对于张展案情的现状，李大伟认为，中共当局也处于两难之中，“要判吧，这个案子不同于其它案子，是因为武汉肺炎而起的，尤其张展是披露事实真相。现在中国政府也是因为武汉肺炎已经是四面受敌，成了孤家寡人了，大家都在谴责它，甚至要赔偿，在这个时候要把公民记者判了，无非是给自己找更大的麻烦。”

“不判吧，张展在里面绝食抗争，一步也不让，她的性格是这样。不让步，对方下不了台，就僵持住了。”

李大伟说，据他所知，国保或检察院提审张展的时候，张展连监舍门都不出，“她拒绝接受提审，听说如果开庭的话，她都拒绝到庭。她不承认中国有司法。”

李大伟了解到，张展的辩护律师现在只剩戴佩清一人，另一位律师闻宇10月底会见张展时已表明，因受到压力，不能继续代理此案。

李大伟透露，办案国保曾经威胁张展妈妈，声称张展在武汉时“编造谎言”：一是称政府对武汉市民进行核酸普筛时收费；二是说封城期间，小区保安给住户配送的是腐烂变质的蔬菜。

受难者家属张海驳斥当局指控

对于当局对张展的指控，武汉受难者家属张海接受大纪元记者采访时对当局的说法一一驳斥。

张海说，当时他一直在武汉，武汉做核酸检测有收费，这并不是谣言。就因为在武汉做核酸检测收费，而他知道在深圳做核酸检测是免费，所以他一直等到离开武汉，回深圳才做了核酸检测。

关于武汉当时做核酸检测要收费的时候，张海说，他的第一个感觉就是，非常气愤，“为什么，因为地方政府瞒报，导致病毒的大爆发，在武汉的大爆发，但是你做核酸检测反而要收费，对这一点我感到特别气愤。”

关于武汉送烂菜的问题，张海回忆说，武汉封城后，有全国各地送来的爱心菜，但是武汉市地方政府，把爱心菜送到超市里面去（卖），他亲眼看到很多人发的视频，很多爱心菜都烂了，并没有送给当时因为武汉封城，生活物资很紧缺的人。

此外，张海说，他待在武汉很长的时间，都没有收到所谓的爱心菜，哪怕是烂的，都没有，但看到别人在微博发了帖说收的菜是烂的。

张海回忆说，那个时候因为封城、封小区，很多人不能出去，不得不买高价菜，对于一些人因为有渠道的、有关系，通过卖菜获得暴利二十多万，感到很愤怒。

张海的父亲因为当局瞒疫，于年初感染中共病毒不幸离世。张海曾发起设立罹难者纪念碑，但遭到打压。之后他多次提交控告或申请材料，向武汉政府和中共官员追责。

对于张展面临的遭遇，张海表示，他一定要为张展发声，因为道理很简单，“如果没有人出来，做证明，我相信不久，这个帽子就会落到我们这边，追责的人身上”。

“真正造谣的是武汉政府”

张海说，他始终认为，真正造谣的就是武汉市地方政府，特别是周先旺——现任的武汉市市长，当初发布“可防可控，不存在人传人”的消息，“这就是典型的造谣，这种就应该给他定罪，这种人就应该受到人民审判，这样才能给我们这些家属带来安慰。”

但是“现在是搞反了，这些造谣者，一点事都没有，说真话的人，反而被扣以造谣的罪名”。

张海说，现在很多罹难者家属都受到打压，不少家属考虑到家人、孩子不敢发声，但是心中是特别的愤恨，只能在家属群里面表达这种愤恨。

他自己也遭遇各种威胁、监控，并且对他和家人实行人脸识别。这让他非常气愤。但他对此也无所畏惧。

“我曾经跟他们很直率地说过，如果你们认为我有罪，你们就来抓我，如果我没有罪，你们搞这些东西，没用的。搞这些，所谓的很恐怖，我说我坚决不会吃你们这一套。换句话说，我如果不发声的话，到时候，无法给我父亲一个交代。所以，这就是我一直坚持发声的动力。”
